Legal terms for the GoGo E-Mobility lease-to-own electric bike programme and battery swap services in Accra, Ghana.

These Terms of Service ("Terms") govern your application for and use of the GoGo E-Mobility lease-to-own electric bike programme and the associated battery swap network ("Services") in Accra, Ghana. By submitting a lease application, taking delivery of a bike, or otherwise using our Services, you agree to be bound by these Terms and by any separate lease agreement signed at delivery.

1. Acceptance of Terms

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use our Services. The signed lease agreement provided at bike delivery sets out the binding contractual terms; in the event of any conflict between these Terms and the lease agreement, the lease agreement prevails.

2. Eligibility

  • You must be at least 18 years of age
  • You must hold any Ghanaian driver's licence required by law for the operation of an electric two-wheeler, where applicable
  • You must provide a valid Ghana Card or other government-issued identification
  • You must have the legal capacity to enter into binding contracts in Ghana
  • You must not be subject to any legal disqualification from riding

3. Application and Onboarding

Application Requirements

  • Provide accurate, complete, and current personal information
  • Submit valid identification and supporting documents
  • Pay the initial deposit before bike delivery
  • Sign the lease agreement at the time of delivery
  • Keep your contact information up to date for the duration of the lease

Account Security

You are responsible for maintaining the confidentiality of any credentials provided to you and for all activity carried out using them. Notify us immediately if you suspect unauthorised use.

4. Service Description

Lease-to-Own Electric Bike

  • Lease one of our electric bikes with a structured path to full ownership over 12 months (48 weekly payments)
  • Up to 110 km of range per fully charged battery
  • Free helmet, jacket, and rider kit at delivery
  • Onboarding, payment confirmations, and customer support primarily via WhatsApp

Battery Swap Network

  • Access to ARC Ride battery swap stations across Accra
  • Stations approximately every 3 km, including TOTAL petrol station partners
  • Swap a depleted battery for a fully charged one in under 1 minute
  • Smart pricing: unused battery capacity is credited back at swap time

5. Fees and Payments

Initial Deposit

An initial deposit is payable before bike delivery. The amount depends on the package selected:

  • 1 Rider: GHS 10,000
  • 2 Riders: GHS 7,500 per rider
  • 3 Riders: GHS 5,000 per rider
  • 5 Riders: GHS 3,000 per rider

The initial deposit is non-refundable. It contributes toward the total ownership cost of the bike.

Weekly Payments

  • After delivery, weekly payments are due via Mobile Money (MoMo) for 48 weeks (12 months)
  • Per-rider weekly amounts: GHS 302.50 (1 rider) · GHS 354.25 (2 riders) · GHS 406.25 (3 riders) · GHS 448.00 (5 riders)
  • Equivalent monthly amounts: GHS 1,210 · GHS 1,417 · GHS 1,625 · GHS 1,792 respectively
  • The payment schedule begins on the date of bike delivery
  • Each payment is non-refundable once made

Late Payment Penalty

A late payment penalty equal to 5% of the monthly payment is added for each week a payment remains overdue. The penalty compounds weekly — each additional week of delinquency increases the outstanding penalty.

  • 1 Rider plan: GHS 60.50 per overdue week
  • 2 Riders plan: GHS 70.85 per overdue week
  • 3 Riders plan: GHS 81.25 per overdue week
  • 5 Riders plan: GHS 89.60 per overdue week

Early Payoff Option

You may pay off your full balance early. If the lease is settled within 6 months of bike delivery, the total payable is reduced to GHS 21,890 (instead of the standard GHS 24,500). Early payoff requires written confirmation from us before settlement.

Battery Swaps

  • A full battery swap is GHS 29 and provides up to 110 km of range
  • If you swap before the battery is fully depleted, the unused capacity is credited back at the station
  • Battery swap fees are paid separately at swap stations and are not part of the weekly lease payment

Ownership Transfer

The bike remains the property of the operator until all weekly payments and the initial deposit have been received in full. Upon completion of all 48 weekly payments, full ownership transfers to you and a transfer of ownership is confirmed in writing.

Pricing Changes

Battery swap pricing and any optional service fees may be updated from time to time on at least 30 days' notice. Your locked-in lease deposit and weekly payments will not change for the duration of an active lease agreement.

6. Rider Responsibilities

Safety Requirements

  • Wear a helmet at all times while riding
  • Obey all traffic laws and regulations of Ghana
  • Do not operate the bike under the influence of alcohol or drugs
  • Do not use a phone while riding except with hands-free devices
  • Carry valid identification while riding

Prohibited Uses

  • Carrying more passengers than the bike is designed for
  • Using the bike for any illegal activity
  • Racing or reckless riding
  • Modifying, tampering with, or removing the bike's GPS or battery hardware
  • Selling, sub-leasing, transferring, or pledging the bike during the lease period
  • Using the bike outside Ghana without prior written consent

7. Bike Care and Maintenance

  • Report any damage, theft, or mechanical issues to us immediately via WhatsApp
  • Keep the bike clean and in good working condition
  • Park responsibly and securely
  • Do not perform unauthorised repairs or use unauthorised replacement parts
  • Allow our team reasonable access to inspect or service the bike when requested

8. GPS Tracking and Remote Disable

  • All bikes are equipped with GPS tracking devices
  • We may monitor the bike's location at any time during the lease period
  • We reserve the right to remotely disable a bike for non-payment, suspected theft, breach of these Terms, or breach of the lease agreement
  • Tracking and remote-disable capabilities are essential to the lease arrangement and may not be tampered with or removed

9. Liability and Indemnification

Assumption of Risk

Riding an electric bike carries inherent risks. By using our Services, you acknowledge those risks and accept full responsibility for your own safety and that of others around you while operating the bike.

Limitation of Liability

To the maximum extent permitted by law, GoGo E-Mobility shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our Services or from your operation of a leased bike.

Indemnification

You agree to indemnify and hold GoGo E-Mobility harmless from any claims, damages, or expenses arising from your use of the bike or our Services, including (without limitation) personal injury, property damage, traffic offences, or third-party claims caused by your conduct.

Insurance

Comprehensive insurance is included with every lease and is built into your plan at no additional cost. Insurance coverage runs for the duration of the lease. Specific policy terms, including covered events, exclusions, claim procedures, and limits, are set out in the insurance documentation provided at delivery and are governed by the policy of our insurance partner.

10. Service Availability

  • Our Services are currently available within designated service areas in Accra
  • Bike availability is subject to demand and operational factors
  • We may suspend or restrict Services for maintenance, safety, or other operational reasons
  • Battery swap station coverage may vary and is subject to change

11. Default, Termination, and Repossession

Missed Payments

  • Missed weekly payments may result in the bike being remotely disabled
  • You will be contacted via WhatsApp before any disable action where reasonably possible
  • Continued non-payment may result in repossession of the bike

Repossession

  • On repossession the lease agreement terminates immediately
  • All payments previously made — including the initial deposit — are non-refundable
  • You must return the bike, battery, and all accessories in good condition on request

Termination by GoGo E-Mobility

We may terminate the lease and our Services immediately for material breach of these Terms or the lease agreement, fraudulent activity, theft, or any conduct that threatens the safety of riders, the public, or our assets.

12. Intellectual Property

All intellectual property rights in our Services, including software, designs, trademarks, branding, and content, remain the property of GoGo E-Mobility and its licensors. You may not use our intellectual property without prior written consent.

13. Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of Ghana. Any disputes are subject to the exclusive jurisdiction of the courts of Accra, Ghana.

Good-Faith Resolution

Before commencing formal proceedings, the parties agree to attempt to resolve any dispute in good faith via direct discussion, including through WhatsApp or in-person meeting.

14. Privacy

Your privacy matters to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

15. Modifications to Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be communicated via WhatsApp or email where reasonably possible. Your continued use of our Services after a change constitutes acceptance of the updated Terms.
